Terms of Service
These Terms of Service ("Terms") govern your access to and use of Majhi OS, operated by Majhi Group ("we", "us", "our"). By creating an account or using the platform, you agree to be bound by these Terms. If you are accepting on behalf of an organisation, you represent that you have authority to bind that organisation.
1. The service
Majhi OS is a software-as-a-service (SaaS) recruiting operating system that automates talent sourcing, screening, outreach, and pipeline management. We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the platform during your subscription term, subject to these Terms.
2. Account obligations
- You must provide accurate, current, and complete registration information.
- You are responsible for maintaining the confidentiality of your credentials and all activity under your account.
- You must notify us immediately at [email protected] if you suspect unauthorised access.
- Accounts are for the registered organisation only. Sharing access with third parties outside your organisation is not permitted.
- You must be at least 18 years old and have legal capacity to enter into contracts.
3. Acceptable use
You agree not to use the platform to:
- Violate any applicable law, regulation, or third-party rights
- Process sensitive personal data (health, financial, biometric) of candidates without appropriate legal basis
- Conduct discriminatory hiring practices based on protected characteristics
- Send unsolicited commercial communications in violation of anti-spam laws
- Reverse-engineer, decompile, or attempt to extract the source code of the platform
- Use automated means to access the platform beyond the provided API
- Introduce malicious code, viruses, or disruptive components
- Resell, sublicence, or offer the platform as a white-label service without written authorisation
4. Intellectual property
Majhi OS and all associated technology, algorithms, models, designs, and content are the exclusive intellectual property of Majhi Group. These Terms do not grant you any ownership rights. You retain all rights to the data you bring to the platform (your mandate data, internal documents, candidate submissions). You grant us a limited licence to process that data solely to deliver the service.
5. Subscription, pricing, and payment
- Subscriptions are billed in advance on a monthly or annual basis, as selected at signup.
- All fees are exclusive of applicable taxes (GST, VAT, etc.), which you are responsible for.
- Annual plans are non-refundable except as required by law or where we materially breach these Terms.
- We reserve the right to change pricing with 30 days' notice. Existing annual subscribers are protected until their renewal date.
- Overdue payments may result in service suspension after a 7-day grace period.
6. Service availability and SLA
We target 99.5% monthly uptime for the core platform, excluding scheduled maintenance (notified 48 hours in advance) and events beyond our reasonable control. Status updates are available at status.majhi.tech.
7. Confidentiality
Each party agrees to keep confidential any non-public information disclosed by the other party in connection with the service. This obligation survives termination for 3 years. It does not apply to information that is publicly available, independently developed, or required to be disclosed by law.
8. Termination
You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of the current billing period. We may suspend or terminate your account immediately if you materially breach these Terms, engage in fraudulent activity, or pose a security risk. On termination, your data will be retained for 30 days and then deleted, unless you request earlier deletion.
9. Limitation of liability
To the maximum extent permitted by law, Majhi OS's total aggregate liability for any claims arising under or related to these Terms shall not exceed the fees paid by you in the 12 months preceding the claim. In no event shall either party be liable for indirect, incidental, punitive, or consequential damages, even if advised of the possibility of such damages.
10. Warranties and disclaimers
We warrant that the platform will perform materially as described in our documentation. Other than this, the platform is provided "as is". We do not warrant that it will be error-free, uninterrupted, or that it will meet all your requirements. Hiring decisions remain entirely your responsibility.
11. Governing law and disputes
These Terms are governed by the laws of India. Any dispute shall first be subject to good-faith negotiation. If unresolved within 30 days, disputes shall be referred to binding arbitration under the Arbitration and Conciliation Act, 1996, seated in Bhubaneswar, Odisha. Notwithstanding this, either party may seek injunctive relief in any court of competent jurisdiction.
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be notified by email at least 14 days before they take effect. Continued use of the platform after the effective date constitutes acceptance of the updated Terms.
